Terms of Service

1. Who you are contracting with

poisettx is operated by FH Holding B.V. (trade name poisettx), Chamber of Commerce no. 96980206, Boezemlaan 52 A, 3034 XD Rotterdam, the Netherlands("poisettx", "we"). By creating an account or using the service you agree to these terms on behalf of yourself and, where applicable, the organization you represent.

2. The service

poisettx provides a software platform for preparing, running, and evaluating cybersecurity tabletop exercises, including AI-generated simulations, documents, AI exercise participants, and reports. We continuously improve the service; features may change, provided the core functionality you pay for is not materially reduced during a paid term.

3. Accounts and acceptable use

• Keep your account access secure; you are responsible for activity under your account.
• Use the service only for lawful, internal training and preparedness purposes.
• Do not attempt to gain unauthorized access to the service or other organizations' data, overload the platform, resell access, or use it to develop a competing product.
• Do not upload content you have no right to share or that is unlawful.

4. Subscriptions and billing

Paid plans are billed in advance through Stripe on a monthly or annual cycle, per the pricing shown at checkout. Plans renew automatically until cancelled; cancellation takes effect at the end of the current billing period. Plan limits (members, exercise participants, features) are part of the plan description. We may change prices with at least 30 days' notice, effective from your next billing period.

5. Your data

You retain all rights to the data your organization puts into the platform: documents, organization context, exercise content, and transcripts. You grant us the limited right to process that data to operate the service, as described in our privacy policy. On account deletion we delete your workspace data.

6. AI-generated content

Simulations, documents, agent messages, and reports are generated by AI and are fictional training content. They are not legal, security, or compliance advice, and they may contain inaccuracies. You are responsible for reviewing AI-generated policy documents before adopting them and for any decisions made based on exercise outcomes.

7. Intellectual property

The platform, including its software, design, and documentation, remains the property of FH Holding B.V.. You receive a non-exclusive, non-transferable right to use it for the duration of your subscription. AI-generated output created from your data within your workspace may be used freely by your organization.

8. Availability and support

We aim for high availability but do not guarantee uninterrupted service. Support is provided per your plan (email, or a dedicated account manager on Enterprise). Planned maintenance is announced where reasonably possible.

9. Liability

To the maximum extent permitted by law, our aggregate liability arising out of or related to the service is limited to the amounts paid by your organization in the 12 months preceding the claim. We are not liable for indirect or consequential damages, loss of data caused by factors outside our control, or decisions made based on fictional exercise content. Nothing in these terms limits liability for intent or gross negligence.

10. Termination

You may stop using the service and cancel at any time. We may suspend or terminate accounts that materially breach these terms, after notice where reasonable. Sections that by their nature survive (data ownership, liability, governing law) survive termination.

11. Governing law and venue

These terms are governed by the laws of the Netherlands. Disputes are submitted to the competent court in Rotterdam, unless mandatory law provides otherwise.
